TERMS & CONDITIONS

These Terms and Conditions form a client agreement between you the client (hereby referred as you, your) and Kelly’s Milky Way, ABN 76167468136 (Kelly Maughan RM/IBCLC).

These Terms and Conditions also include the Fee Schedule which you must read along with these terms and conditions.

In making a booking with Kelly’s Milky Way you are accepting these Terms and Conditions and Fee Schedule.

DESCRIPTION OF SERVICE

These Terms and Conditions relate to services provided by Kelly’s Milky Way which can include; antenatal breastfeeding education, breastfeeding initial and follow-up consultations, group breastfeeding sessions, baby weight and breastfeeding checks, as well as additional phone and video breastfeeding support. As an Endorsed Midwife my scope includes diagnostics and lactation specific prescription medication where required. I currently perform all consults on home visits, via phone (telehealth) and email support, and with written material.

BOOKINGS

By booking your appointment you are accepting Kelly’s Milky Way Cancellation and ‘No Show’ Policy and Fee Schedule as outlined in these Terms and Conditions.

PAYMENT AND FEE SCHEDULE

You accept the Fee Schedule as it pertains to the relevant services you have booked, including travel and cancellation fees (if applicable).
Payment is required when booking your appointment.
Payment for services can be made online through my website.
You understand that Kelly Maughan (RM/IBCLC) will to the best of her ability apply her services in a way which will allow for a Medicare rebate or Private Health Insurance coverage (if applicable). A rebate is not guaranteed as conditions apply.

Antenatal Breastfeeding Education $80 per session
Breastfeeding Assessment and Weight Review $100
Initial Consultation $195 per session
Follow Up Consultation $120 per session (if within 1 month since initial consult), $150 if more than 1 month since last contact.
Travel Fee (if applicable, see FAQ section for suburbs I service) $50
Cancellation Fee $50 (see below)
Extended home consultations $50 per 30 minutes (see below).
Additional Phone Support: $50 per week.

CANCELLATION POLICY

24 hours notice is required to cancel or reschedule your appointment.
If you cancel your booking within these 24 hours a cancellation fee of $50 will be applied.
New appointment times are subject to availability.
If your appointment is cancelled by Kelly’s Milky Way within 24 hours of your appointment time, no financial penalty will be incurred by you and any deposits will be refunded to you.
A “No Show” occurs in the event that Kelly’s Milky Way arrives at the designated appointment address at the appointment time and you are not there within 15 minutes of the appointment commencing.
In the event of a ‘No Show’ all reasonable attempts will be made by Kelly’s Milky Way to contact you at this time.
In the event of a 'No Show' you forfeit your appointment funds and will not receive a refund. This covers the cost of my time which I was unable to be available for another mum and baby.
If you are late to an appointment but still attend, your appointment will not be extended to allow for the time in which you were not in attendance. Other mums and babies need my help too!
Payment plans can be made on a case-by-case basis if this enables you to receive the service that you and/or your baby need. Please contact me if this applies to you.

EXTENDED HOME CONSULTATIONS

Extended home consultations can be offered beyond the duration as described while booking. These attract an additional fee of $50 per 30 minutes. Any extension of time and additional charge is discussed and accepted by both parties before proceeding and may not always be available.

LIMITATION OF LIABILITY

To the extent permitted by law I, Kelly’s Milky Way (Kelly Maughan RM/IBCLC), will not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

You agree to indemnify, defend and hold harmless Kelly's Milky Way (Kelly Maughan RM/IBCLC) from any claim or demand, including legal fees, made by any third party due to, or arising out of, your breach of these Terms and Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

DISPUTE RESOLUTION PROCESS

Kelly’s Milky Way is committed to their clients and their customer satisfaction. If, in the event you are unhappy with the services provided by Kelly’s Milky Way I encourage you to contact me at kellysmilkyway@gmail.com to discuss your complaint and rectify if appropriate.

Your safety is my priority, and I'm committed to providing you with the best possible customer service experience while protecting your personal and health information.

YOUR PERSONAL INFORMATION

When you book an appointment, you will be asked to submit a lot of personal information. I need this to:

Know who & where you are
Aid diagnosis and create a management plan
Communicate with you
Collect payments from you
Comply with my legal obligations

DISCLOSURE OF YOUR INFORMATION

Your care plan may require the involvement of other allied health practitioners - in this instance your consent would be sought before your personal details are shared for collaboration purposes.

Kelly’s Milky Way will make every attempt to protect the privacy of your personal health information as required by the Code of Ethics of the International Board of Lactation Consultant Examiners, and the Standards of Practice of the International Lactation Consultant Association. Kelly’s Milky Way is also bound by the Privacy Act 1988, which sets out a number of principles concerning the privacy of individuals as well as the Australian Privacy Principles (APPs). This Privacy Policy relates to both use of this website (kellysmilkyway.com) and the midwifery and lactation support services provided by Kelly’s Milky Way.

Your personal, health or financial information will never be shared with a third party without your consent, unless required and permitted by law.

INFORMATION SECURITY

I am committed to protecting your personal information, and as such I do my best to ensure your personal information is protected from misuse, loss, interference and unauthorised access, modification or disclosure. For example, whenever I ask for your financial details online, I use security-encrypted response forms and your information is held in secure servers.

However, data protection and security measures are never completely secure and, despite the measures I have put in place, I cannot guarantee the security of your information. You must take care to protect your personal information (for example, by protecting any usernames and passwords) and you should notify me as soon as possible of any security breaches.

Signature of this form is required at commencement of care and will be sent upon booking.
